The Right to Information Act 2005 (RTI)<\/h1>\n

is an Act of the Parliament of India “to provide for setting out the practical regime of right to information for citizens.” The Act applies to all States and Union Territories\u00c2\u00a0of India, except the State of Jammu and Kashmir – which is covered under a State-level law. Under the provisions of the Act, any citizen (excluding the citizens within J&K) may request information from a “public authority” (a body of Government or “instrumentality of State”) which is required to reply expeditiously or within thirty days. The Act also requires every public authority to computerize their records for wide dissemination and to pro-actively publish certain categories of information so that the citizens need minimum recourse to request for information formally. This law was passed by Parliament on 15 June 2005 and came fully into force on 13 October 2005.[1] Information disclosure in India was hitherto restricted by the Official Secrets Act 1923 and various other special laws, which the new RTI Act now relaxes.<\/p>\n

\n1. To which Public Authority can I file a request?<\/strong><\/p>\n

An applicant who desires to obtain any information under the RTI Act 2005 can make a request through this RTI Online Portal to only the Central Public Authorities of main Ministries\/Departments located at New Delhi initially. In the first phase, this facility is available to make a request to Department of Personnel and Training only.
\n2. How do I write my application for seeking the information as per RTI Act 2005?<\/strong>
\nThe text of the application may be written in the prescribed column of the form. At present, the text of the application is confined up to 500 characters only in the prescribed column of the form.
\nIn case, the text of an application contains more than 500 characters, it can be uploaded as a PDF attachment in the \u00e2\u20ac\u0153Supporting Document\u00e2\u20ac\u009d column of the form.
\n3. How do I make the payment for RTI fee?<\/strong>
\nAfter filling the first page, a non-BPL applicant has to click on \u00e2\u20ac\u0153Make Payment\u00e2\u20ac\u009d button for remittance of the prescribed RTI fee.
\nThe applicant can pay the prescribed RTI fee through the following modes: (i). Internet banking through SBI and its associated banks.
\n(ii). Using ATM-cum-Debit card of State Bank of India.
\nIt may be noted that no RTI fee is required to be paid by any citizen who is below poverty line, as per RTI Rules, 2012. However, the applicant must attach a copy of the certificate issued by the appropriate government in this regard, along with the application.
\n4. Do I get any receipt for online filing of RTI application?<\/strong>
\nOn submission of an application, a unique registration number will be issued, which may be referred by the applicant for any future reference.
\nIt may be noted that the application filed through this RTI Online Portal will reach electronically to the \u00e2\u20ac\u0153Nodal Officer\u00e2\u20ac\u009d of the said Ministry\/Department and \u00e2\u20ac\u0153Not\u00e2\u20ac\u009d to the CPIO of the concerned Ministry\/Department.
\nThe Nodal Officer will transmit the RTI application, either electronically or physically to the concerned CPIO.
\n5. What will happen to my application if I select a wrong Public Authority in the prescribed form?<\/strong>
\nIn case the RTI application is not meant for the Ministry \/Department which has been selected by the applicant, the \u00e2\u20ac\u0153Nodal Officer\u00e2\u20ac\u009d of the said Ministry\/Department will transfer the application electronically to the \u00e2\u20ac\u0153Nodal Officer\u00e2\u20ac\u009d of the concerned main Ministry\/Department located at New Delhi, under section 6(3) of the RTI Act.
\n6. Will I be informed about the additional fee (if any) is required to pay?<\/strong>
\nIn case additional fee representing the cost is required for providing information, the Nodal Officer will intimate the same, which can be viewed by the applicant through \u00e2\u20ac\u02dcView Status\u00e2\u20ac\u2122 option in the RTI Online Portal and an e-mail alert will be sent to the applicant for the same.
\nFor submitting the additional fee online, the applicant needs to use the option \u00e2\u20ac\u02dcView Status\u00e2\u20ac\u2122 in the RTI Online Portal and on providing the registration number of the request option for \u00e2\u20ac\u02dcMake Payment\u00e2\u20ac\u2122 will provided.
\n7. How do I file an appeal with First Appellate Authority?<\/strong>
\nFor making an appeal to the first Appellate Authority, the applicant has to select the option \u00e2\u20ac\u0153Submit First Appeal\u00e2\u20ac\u009d in the RTI Online Portal and fill up the form that will appear.
\nThe registration number of original application may be used for the reference.
\nThe appeal so filed through this RTI Online Portal will also reach electronically to the Nodal Officer of the concerned Ministry\/Department and Not to the first Appellate Authority.
\nThe Nodal Officer will transmit the first appeal to the concerned First Appellate Authority (FAA), either electronically or physically.
\n8. Do I need to make any payment for filing an appeal?<\/strong>
\nAs per RTI Act, no fee has to be paid for first appeal.
\n9. Do I get any SMS from RTI Online Portal?<\/strong>
\nThough optional, the mobile number can be provided by the applicant\/ appellant in order to receive SMS alerts.<\/p>\n
